Terms of Use

1. Agreement

By using the website or app, you agree to these terms and the related Privacy Policy and Health and Medical Disclaimer. If you do not agree, do not use the service.

2. General wellness service

The ring and app provide general wellness information, biometric trends and breathwork guidance. They are not medical services or medical devices and are not a substitute for professional diagnosis or treatment.

3. Appropriate use

You must use the ring, app and breathing guidance lawfully, safely and in accordance with supplied instructions. Do not misuse the service, interfere with its operation, attempt unauthorised access or use it in a way that could harm another person.

4. Accounts, devices and compatibility

You are responsible for your compatible phone, operating system, permissions, connectivity and device security. Features may vary by phone, ring firmware, connected services and permissions. The Android app is available now; iPhone availability remains subject to completion of testing and release.

5. Purchases and deposits

Prices are displayed in Australian dollars unless stated otherwise. Payments are processed through the checkout provider shown at purchase. An iPhone first-batch deposit reserves a place in that batch; final package selection, remaining balance, expected availability and delivery arrangements will be confirmed separately.

6. Coaching and Academy services

Guided and Academy packages include the services described at the time of purchase. Scheduling depends on mutual availability. Coaching is educational and wellness-focused, not medical or psychological treatment.

7. Intellectual property

The app, website, branding, written content, assessment structure, reports and guidance are owned by or licensed to Elite Performance Through Breath. Personal use is permitted. Reproduction, resale or commercial redistribution requires written permission.

8. Availability and changes

Reasonable efforts are made to keep the service available and accurate, but uninterrupted operation is not guaranteed. Features, compatibility and content may change as the product develops or to meet legal, safety and platform requirements.

9. Liability

Nothing in these terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law. To the extent permitted by law, liability is limited to reasonably foreseeable loss directly caused by a failure to provide the service with required care and skill.

10. Governing law

These terms are governed by the laws of Queensland, Australia. Courts with jurisdiction in Queensland may hear disputes, subject to any mandatory consumer rights.
